Justice Moberly

Think he'll pick the chick?

Just received word from the state courts' spokeswoman that a formal letter nominating three candidates for the vacancy on the Indiana Supreme Court has been delivered to Gov. Mitch Daniels. (The commission selected the nominees last Friday.) The letter starts the 60-day period Daniels has to make the appointment from among the three contenders -- Boone Circuit Court Judge Steve David, Marion Superior Court Judge Robyn Moberly and Indianapolis attorney Karl Mulvaney. One of them will succeed Justice Theodore Boehm after he retires Sept. 30.

My guess would be yes (and I have such a sterling record of poltical predictions!) -- I don't think Daniels cares sll that much about "gender diversity," the term favored by the politically correct, but he will be under intense pressure to choose Moberly so Indiana doesn't remain one of only two states (with Iowa) without a sitting female justice. If they're all equally qualified (and given the screening process, they should be), there's no particular reason for him not to pick her.
