Opening Arguments

Public private acts

For the "with friends like this, he doesn't need enemies" file:

ST. PAUL, Minnesota - In a legal effort to help a U.S. senator, the American Civil Liberties Union is arguing that people who have sex in public bathrooms have an expectation of privacy.

Republican Senator Larry Craig is asking the Minnesota Court of Appeals to let him withdraw his guilty plea to disorderly conduct related to a bathroom sex sting at the Minneapolis airport last year.

[. . .]

The ACLU filed a brief Tuesday supporting Craig. It cited a Minnesota Supreme Court ruling 38 years ago that found that people who have sex in closed stalls in public restrooms "have a reasonable expectation of privacy."

I hate to disagree with the ACLU and the Minnesota Supreme Court, but an "expectation of privacy" when having sex in public restrooms? What about the expectations of those just want to use the facilties for the purpose intended?

So according to "wide stance" and the ACLU, the cops need a warrant to search a bathroom stall in a public restroom?

Gonna be some busy judges if they win this one.

I can hear it now...

"Police...we have a search warrant...drop the condom, open the stall, and come out with your zipper UP"
